Privacy Policy

The objective of this Data Protection Policy is to inform with transparency how BIOCYMA treats and protects the data that the “User” (understood as “User” as a natural person interested in the services offered by BIOCYMA through its page web), enter in the forms. Prior to the “User” providing their personal data in any of the online forms on the website, BIOCYMA will display a first basic informational data protection notice, and will request the express consent of the “User” through of an unchecked box.

I. Who is responsible for the processing of your data?

BIOCYMA is the company Responsible for the Treatment of the “User’s” personal data.

The “User” may contact us to resolve any questions or needs they may have regarding data protection by contacting our Data Protection Delegate.

II. For what purpose do we process your personal data?

We inform the “User” that BIOCYMA will process the personal data that the “User” provides through the online forms for specific purposes, provided that there is a legal basis that legitimizes the treatment, as detailed in the next section.

The  PURPOSES  derived from the data processing carried out by BIOCYMA on the website are:

III. What is the legitimacy for the processing of your personal data?

The legal basis for the processing of data for the purposes a) and b) is the consent that is requested from the “User” to provide commercial information about the services of BIOCYMA.

The legal basis for the data processing of purpose c) is to make available to the “User” (client) the documentation required by the Occupational Risk Prevention Law (art. 22.3 and 23), as part of the existing contractual relationship between the client and BIOCYMA, as well as the consent (art. 6.1.a ) .RGPD) that is requested from the “User” to process personal data in order to manage the making available of the documentation.

BIOCYMA only collects the information necessary to be able to identify, report and supply the necessary information based on specific purposes. The “User” understands and accepts that BIOCYMA will not be able to carry out the services of supplying information about the services of  BIOCYMA.

How long do we keep your personal data?

We will keep the data related to the treatments a) and b) for the duration of the contractual relationship, and until the “User” does not request that we delete them. Without prejudice to the fact that the conservation of the data may be necessary, either to formulate, exercise or defend a claim, or due to a legal provision.

IV. Who has access to your personal data?

BIOCYMA shares data with third parties in the following cases:

Internet service providers: To carry out the services that BIOCYMA provides through its website requires that other third-party companies that provide email services and data hosting on behalf of BIOCYMA process personal data as Managers of Treatment. These Internet service providers can access the personal data of the “User” and we require them to use it only as indicated to provide the service we request.

For legal compliance: Personal data transfers or communications will be carried out, in accordance with current legislation, in order to meet their obligations with Public Administrations and, where appropriate, also with other bodies such as Security Forces and Bodies of the State and judicial bodies.

Right of access

When you exercise your right of access, BIOCYMA will inform you of:

  1. The purposes of the treatment
  2. Categories of personal data that are processed
  3. Possible data communications
  4. Recipients of possible data communications.
  5. Period of conservation of your data, if possible. If not, the criteria to determine this term.
  6. Of your right to request that we rectify or delete the data, that we limit the treatment, or oppose it.
  7. Of your right to file a claim with the Spanish Agency for Data Protection
  8. If an international data transfer occurs and inform you of the appropriate guarantees.
  9. The existence of automated decisions (including profiles), the applied logic and consequences of this treatment.

Right of rectification

When you exercise your right to rectification, you require BIOCYMA to:

  1. Rectify your inaccurate personal data
  2. Fill in your incomplete personal data

Right of erasure

When you exercise your right of deletion, you require BIOCYMA to delete your personal data, if any of the cases contemplated in the Law concur, such as that the data is no longer necessary for the purpose for which it was collected.

Right of limitation of treatment

When you exercise your right to limit the treatment, you require BIOCYMA to suspend or keep the processing of personal data for the exercise and defense of claims, protect the rights of another person or for reasons of public interest

Right to data portability

When you exercise your right to portability, you require BIOCYMA to send you your personal data provided in a structured format for common use and mechanical reading, and to be able to transmit them to another person in charge, whenever possible.

Right of objection

When you exercise your right to object, you require BIOCYMA to:

  1. Cease the processing of your data for reasons related to your personal situation, unless BIOCYMA proves a legitimate interest or is necessary for the exercise or defense of a claim.

The company adopts the technical and organizational measures necessary to maintain the confidentiality, integrity and availability of the information it deals with in its information system.

VII. Sending commercial and informative communications

BIOCYMA only sends commercial and informative communications related to the activities of the company and that are of interest to the “User”.

The “User” has the right to revoke at any time the consent given to receive commercial communications by simply notifying BIOCYMA, based on article 22 of Law 34/2002 on Services for the Information and Commerce Society Electronic.

VIII. Modification of the Data Protection Policy

BIOCYMA reserves the right to modify this Data Protection Policy in order to adapt it to new legislation or interests of the entity.
